You will not be able to reactivate your account at a later stage after you have deleted it.

The Company reserves the right to terminate this Agreement and your access to your User Account at any time without giving any notice to you, if we find that

  • You have violated the terms of this Agreement

  • Your conduct is harmful to the Company or any of its Users; or

  • We cease our business operations for any reason.

Produce Prices

We do not sell any products through our Website and therefore we do not display any product prices. Please note in the unlikely event that you see a price list on our Website, such prices may be the prices as provided by a specific dealer and not the prices offered by the Company. Product Warranty

Unless expressly stated otherwise, we do not offer any warranties or guarantees for any products of any nature.

Where we offer manufacturer’s warranties for our Products, such warranty will be specified on our Website and the customer will be required to contact the dealer from whom they purchased the product and follow the instructions provided by the dealer. Please note that you may be required to provide the following information to the dealer:

  • Proof of purchase / order number;

  • A detailed description of the issue with your product;

  • What caused the issue.

In certain circumstances you may be required to send clear pictures of the product to enable the dealer to assist you with your claim and you may be required to send the product back to the return address provided by the dealer at the time. Please ensure that return shipment is securely packaged to prevent any damage to the items during shipping.

Product warranty does not cover any shipping costs for replacements and such costs will be borne by the Customer who wishes to claim the warranty

Intellectual Property

All products listed on www.cameochina.com and all content made available by the Company including without limitation all text, images, graphics, logos, trademarks, audio, video, interactive features and the like (“Company Content”) are owned by and/or licensed to the Company and subject to trademark, copyright and other intellectual property rights under the local and international laws and conventions. You agree not to copy, sell, transfer, license, sublicense, assign, reproduce, republish, disassemble, decompile, reverse engineer or distribute any Company Content in any way except as intended under the Agreement. You further agree not to adapt, alter or create derivative work from any Company Content without the prior written permission of the Company. You agree not to remove any copyright, trademarks and any proprietary notices from any Company Content. You understand that any use of Company Content on any website, system or application that is not owned and operated by us is strictly prohibited.

We hereby grant you a revocable, limited, non-exclusive, non-transferable license to use the Company Content for your personal and noncommercial use only.

We reserve the right to prosecute any violations of this provision to the fullest extent permitted by law. You acknowledge that breach of this provision can incur criminal as well as civil liability

Limitation of Liability

In no event shall the Company, its directors, officers, employees, shareholders and agents be liable for any loss of profits, loss of opportunity, costs incurred in procurement of substitute products or indirect, incidental, special or consequential damages, arising from our related to the use of products. Where the court of law finds the above exclusion of liability is inapplicable, the total liability of the Company shall not exceed fifty US Dollars or the amount paid by you to the Company in the month when the dispute first arose. THE ABOVE LIMITATION OF LIABILITY SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED IN LAW.

THE COMPANY MAKES NO REPRESENTATION REGARDING THE AVAILABILITY OF PRODUCTS IN ANY GEOGRAPHIC LOCATION THAT ARE NOT LISTED ON OUR WEBSITE

Indemnity

You agree to release, defend, indemnify, and hold harmless the Company, its founders, employees, affiliates, subsidiaries against any claims, liabilities, charges, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, asserted against you by any third party as a result of your:

(i) Violation of these Terms by you;

(ii) Your gross negligence or willful misconduct, or;

Governing Law and Jurisdiction

The agreement shall be governed by the federal laws of Canada. Both the User and the Company agree to submit to the exclusive jurisdiction of the courts located in Secaucus. New Jersey

No Class Action

Neither the Company nor the User shall bring any action against the other as a class member in any class action. Any claim brought by the Company or the User must be brought in their own individual capacity.

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ THE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THESE TERMS

Severability

If applicable law finds any provision of this Agreement to be unlawful, void, or for any reason unenforceable, then such provision will only be limited to the minimum extent necessary and such limitation will not impact the validity and enforceability of the remainder of this Agreement

Force Majeure

Neither the Company nor the User will be held liable for failure to perform any of its obligations towards the other if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or any interruption or any failure of electricity or server, system, computer, internet or telephone service
